HIDOE does not have current Memoranda of Understanding (MOUs), including Infrastructure Funding Agreements (IFAs) in place for three of the four local workforce development areas.

Discussion

The management of the one-stop delivery system is the shared responsibility of States, Local Workforce Development Boards (LWDBs), elected officials, the six WIOA core programs, required one-stop partners, and other additional one-stop partners, one-stop operators, and service providers.  WIOA requires the LWDBs to enter into MOUs with all one-stop partners.  The MOU is an agreement under which each one-stop operates and includes specific information outlined in WIOA law and regulations.  The MOU must contain the signatures of the LWDB, one-stop partners, the chief elected official(s), as well as identify the duration of the MOU and procedures for amending it.  The IFA, which supports the costs associated with the one-stop delivery system, is a component of the MOU.  The MOUs must be reviewed and updated not less than every three years to reflect any changes in the signatories or partners, operations of the one-stop, or one-stop infrastructure funding.  IFAs should be reconciled annually and adjusted accordingly.

Hawaii has four local workforce areas across the State.  Two of the local workforce areas, Oahu and Maui, have noncompliant MOUs that are lacking the required signatures.  One local workforce area, Kauai, does not have an MOU in place.  The review team confirmed that one local workforce area, Hawaii county, does have a compliant MOU, including an IFA, that will expire in April 2024.  The noncompliant MOUs were executed at various times, with end dates in 2025 and 2026.

The State must ensure that all local workforce areas have current and compliant MOUs, including IFAs.

Finding

HIDOE expended State leadership funds for a staff position that did not include responsibilities for implementing State leadership required activities.

Discussion

State agencies may use state staff positions or procure contracts to fulfill State leadership requirements.  During program years (PYs) 2020 and 2021, HIDOE procured a contract with LiteracyPro to provide LACES data review and analysis for program improvement and to produce technical assistance modules for subrecipients, which are allowable State leadership expenditures.  Additionally, HIDOE also expended PY 2020 and PY 2021 State leadership funds for an Education Program Specialist position.  However, HIDOE was not able to provide documentation that demonstrates how the Education Program Specialist position included responsibilities to implement any of the required State leadership activities.  This resulted in State leadership funds being expended for a State staff position that did not carry out any State leadership responsibilities.

HIDOE did not expend AEFLA funds for all State leadership requirements.

Discussion

State agencies may use up to 12.5% of their AEFLA funds for required and permissible State leadership activities.  States must expend AEFLA funds on each of the following four required activities: (1) aligning adult education and literacy activities with other core programs and one-stop partners, (2) establishing or operating high quality professional development programs to improve program instruction, (3) providing technical assistance to eligible providers, and (4) conducting monitoring and evaluation activities to improve the adult education program.  However, HIDOE did not provide evidence of expenditures using State leadership funds to ensure alignment of the AEFLA program with the other core programs and one-stop partners or monitoring and evaluation activities.  Even though HIDOE used some of their State leadership funds for allowable activities, the State must expend State leadership funds on each of the four required activities.
